Terms and Conditions

The Certified Executor Advisor (CEA) designation is granted subject to your acceptance of the terms and conditions outlined below by the Institute of Certified Executor Advisors (ICEA). Your use of this site and the CEA designation signifies your agreement to abide by these Terms and Conditions. If you do not wish to adhere to these Terms and Conditions, you are not authorized to use the CEA Designation or access the CEA member's site.

Authorization to Use CEA Designation

To qualify for the use of the CEA designation, candidates must complete the CEA curriculum, pass the quizzes and examination, maintain active membership with the Institute of Certified Executor Advisors, fulfill the prescribed continuing education requirements mentioned below, and adhere to the ICEA Code of Conduct, also available on this site.

Continuing Education Obligations

ICEA mandates that CEAs complete 10 hours of continuing education (CE) each year, starting in their second year of membership, to ensure their knowledge remains current. This continuing education should focus on executor-related issues, estate planning, and any governmental legislative changes. Eligible activities include attending or teaching applicable educational sessions, reading relevant articles or watching videos, and/or attending relevant conferences. CEAs will be required to confirm the completion of these credits upon request.

Disciplinary Action

In the event of client complaints or any observed violations of these Terms and Conditions or the Code of Conduct, ICEA will investigate the matter and, if necessary, refer it to the disciplinary committee. This committee is responsible for conducting a thorough investigation with all parties involved and holds the authority to issue reprimands, suspensions, or membership terminations.

Jurisdiction

ICEA holds exclusive jurisdiction over all matters related to discipline and violations associated with your use of the CEA website members' areas and the CEA Designation. All legal matters regarding these issues fall under the jurisdiction of the courts of the State of Florida. Please note that no waiver of any of these Terms and Conditions is valid unless provided in writing with the proper signed authorization from ICEA.

Indemnification

As a CEA, you commit to defending, indemnifying, and holding ICEA officers, directors, employees, agents, and suppliers harmless from any claims, actions, demands, and liabilities, including reasonable legal and accounting fees, resulting from any breach of these Terms and Conditions and the Code of Conduct.

Members-Only Authorization

Authorization for using terms such as "Certified Executor Advisor" or "CEA" and accessing the CEA members-only areas is strictly reserved for Certified Executor Advisor members in good standing with ICEA only.

No Warranty or Representation

As a CEA, you agree not to make any express or implied warranties beyond the scope of the information contained in the CEA course and/or curriculum.

Members and General Public Report of Misconduct

ICEA recognizes the importance of professional, ethical, and competent behavior by CEA members at all times. If you believe that the service received from a CEA member or the actions of a fellow CEA have been unprofessional, unethical, or incompetent, it is both your right and responsibility as a CEA to report it.

Reproduction of ICEA Logo and Use

Reproduction of the logo mark must be from original artwork requested directly from ICEA by emailing LEARN@CEA.PRO. The ICEA logo must not be altered in any way for any use. The use of the ICEA name, logo, or terms "Certified Executor Advisor" or "CEA" is restricted to members only unless otherwise provided for in writing by the ICEA. ICEA retains authority over logo and term usage and has the final say in granting permission for use.

Revocation of Designation Usage

Failure to fulfill the required continuing education, unreported or observed misuse of the CEA designation, and/or the ICEA, or any violations of the Code of Conduct will result in disciplinary actions taken at the sole discretion of ICEA. ICEA has the absolute authority to revoke your rights to use the CEA Designation in the event of any non-compliance with these standards.

Complete Agreement

These Terms and Conditions constitute the entire agreement between you and the Institute of Certified Executor Advisors (ICEA) regarding the use of the ICEA, the CEA designation, the CEA website, and its content.

Restrictions on Use of Materials

CEA websites and their contents are owned by ICEA or its licensors and are protected by United States and foreign copyright and trademark laws. Reproducing, duplicating, or distributing CEA websites and/or their contents for anything other than personal and/or non-commercial use is a violation of these Terms and Conditions, as well as copyright and trademark laws, unless written permission from ICEA is obtained.

The forms available in the tools section on ICEA Websites are provided for commercial, personal, or educational purposes. Content modification is prohibited, and the ICEA logo must be included on every display and copy of the content. No other uses are permitted. Nothing herein grants any rights under any copyright of ICEA or any other copyright owner of the content on CEA websites.

All trademarks and trade names are either trademarks or registered trademarks of ICEA, its affiliates, or their respective owners. Displaying trademarks or trade names on the websites does not grant any license or other rights in these marks or names. Unauthorized use of these trademarks and trade names is strictly prohibited.

Jurisdiction and Governing Law

CEA websites are controlled and operated by ICEA in Florida, United States of America. If you access these Websites from another location, you are responsible for complying with local laws, where applicable.

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Florida, United States of America, without regard to conflicts of law principles. You consent to any legal action related to these Terms and Conditions or CEA Websites being filed exclusively in the state or federal courts of Florida, United States of America, and you submit to the jurisdiction of such courts. Regardless of any statute or law to the contrary, any claim or cause of action arising from or related to the use of CEA websites, or these Terms and Conditions must be filed within one year of such claim or cause of action arising, or it is barred forever.

Unless prohibited by applicable law, you waive any right to initiate or participate in any class action against us regarding any claim, and where applicable, you also agree to opt out of any class proceedings against us.

User Conduct, Indemnification, and License Granted

Postings created by users on any part of ICEA Websites, including Comment forums, are the responsibility of the user who created them. ICEA is not responsible for Postings but retains the right to review, edit, refuse, or delete any postings for any reason at its discretion. ICEA is not liable for any modification or discontinuation of your postings.

By contributing postings to ICEA websites, you grant ICEA and its affiliates a worldwide, royalty-free, perpetual, irrevocable, and nonexclusive right and license to use, reproduce, modify, edit, adapt, publish, translate, broadcast, create derivative works from, distribute, perform, display, and publicize such content for any purpose, in any form, media, or technology known or developed in the future, without compensation to you. You also acknowledge and waive any moral rights in your postings. ICEA is free to use any ideas, concepts, know-how, or techniques from the Postings for any purpose, including developing, manufacturing, and marketing products, without compensation to you.
